Service Agreements

Monthly Packages

• Monthly packages are billed on a recurring monthly basis
• Services can be canceled with 30 days written notice
• No refunds for partial months
• Pricing subject to change with 60 days notice

One-Time Projects

• Payment terms specified in individual project agreements
• Typical payment structure: 50% upfront, 50% upon completion
• Scope changes may result in additional fees
• Client approval required before final delivery

Client Responsibilities

Clients are responsible for:

• Providing accurate and timely information
• Providing necessary access to accounts, platforms, and materials
• Timely review and approval of deliverables
• Making payments according to agreed terms
• Ensuring all provided content is legally owned or licensed

Intellectual Property

Ownership

• Upon full payment, clients own all custom work created specifically for them
• The Common BusinessMan Solutions retains rights to underlying code, templates, and methodologies
• Third-party assets (stock photos, fonts, etc.) remain property of their respective owners

Portfolio Use

We reserve the right to use completed projects in our portfolio, case studies, and marketing materials unless otherwise agreed in writing.

Warranties and Disclaimers

We warrant that:

• Services will be performed in a professional manner
• Work will be consistent with industry standards
• We have the right to provide the services

However, we do not guarantee specific results from SEO, social media, or other marketing efforts. Digital marketing success depends on many factors, some outside our control.

Limitation of Liability

The Common BusinessMan Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our total liability shall not exceed the amount paid by you for services in the twelve months preceding any claim.

Termination

We reserve the right to terminate services if:

• Payment is not received within 30 days of due date
• Client violates these terms
• Client requests illegal or unethical activities
• Continued service is not feasible

Confidentiality

We will maintain confidentiality of all client information and will not disclose it to third parties except as required by law or with your explicit permission.

Dispute Resolution

Any disputes arising from these terms or our services shall be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in San Francisco, California.

Changes to Terms

We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes constitutes acceptance of the new terms.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
